11th November 2013 - The European Patent Office (EPO) has announced that 2014 will see the reversal of a number of rule changes that have been unpopular with patent applicants. The time limit for filing divisional applications is to be removed - this will reintroduce the possibility of maintaining a pending application for the whole patent life (albeit at a cost). The EPO also intends to allow applicants to pay further search fees to enable allegedly second and subsequent inventions to be searched and subsequently considered during substantive examination. We see these rule amendments as a welcome return to previous practices. Businesses should ensure these changes are factored in to their patent strategy.
